INTRODUCTION

The site www.madameferment.com (hereinafter referred to as the “Site”) is an information and e-commerce site accessible via the Internet, open to all users of this network (hereinafter referred to as “Internet users”). It is edited by the individual entrepreneur Mrs Ducros, registered under the number 91510171100017.
The Site allows Ducros L. to offer ferments for sale (hereafter called “Products”) to Internet users browsing the Site (hereafter called “Users”). The User having validated an order will be called “Customer”. The rights and obligations of the User necessarily apply to the Customer.
Any order of a Product offered on the Site implies the consultation and express acceptance of these general terms and conditions of sale and withdrawal, manifested by checking the box “I declare that I have read and accept the general terms and conditions of sale of MadameFerment and that I am informed of my right of withdrawal”.

ARTICLE 1 – PURPOSE

The purpose of the General Terms and Conditions of Sale set out herein is to define, exclusively for the purposes of the relationship established via the Internet, the rights and obligations of the Parties arising from the online sale of Products offered on the Site.
They regulate all the steps necessary for the placing of the order and ensure the follow-up of this order between the Parties.
These terms and conditions apply to the exclusion of any other document.

ARTICLE 2 – PRODUCTS

2.1 Products

The Products offered for sale by Madame Ferment are those listed on the Site on the day the User consults the Site and within the limits of available stocks.
In the event of unavailability of one of the Products, the customer will be informed as soon as possible.
The photographs and texts illustrating the Products are not part of the contractual field.

2.2 Use of the products

Precautions for use
The Customer is required to check the condition of the products delivered and must take note of their conditions of use. Ferments are not harmless products, they are intended to be used in the hygienic and safety conditions described on the Madame Ferment website.

Home-made” ferments
Madame Ferment offers on its Website ferments intended for individuals to carry out “home” fermentations.
Madame Ferment shall not be held responsible for the use of its Products in the manufacture and marketing of a food product.

Use of fermentations for therapeutic purposes
The information provided on the Site comes from reference books on fermentations. The benefits of fermentations are provided for information purposes only, and in no way constitute medical information, nor shall Madame Ferment be held liable for them.

2.2 Resale of Madame Ferment products

The resale of Madame Ferment products is not authorized unless there is a written and contractual agreement with Mrs. Lorène Ducros, owner of the brand.
Repackaging of Madame Ferment products for resale under another brand name is not allowed unless written agreement is given by Mrs. Ducros.

ARTICLE 3 – PRICES

Prices are indicated in Euros.

Any order placed on the Site and delivered outside the European Union and to the French overseas departments and territories may be subject to possible taxes, customs duties and other related charges that are imposed when the package reaches its destination. These additional costs are the responsibility of the Customer.

The prices indicated on the Site are guaranteed on the day of the order within the limits of available stocks, and except for obvious typographical errors or omissions.
The prices indicated do not take into account the shipping costs which will be invoiced in addition or offered according to the amount of the order and the country of delivery, and will be specified to the User at the time of the final validation of his order.
These shipping costs do not include customs and other additional costs that may be required upon entry into certain countries, and Madame Ferment reserves the right, which the User accepts, to modify its prices at any time.

ARTICLE 4 – ORDER REGISTRATION AND VALIDATION

4.1 Navigation within the Site

The User may view the various Products offered for sale by Madame Ferment on its Site.
The User may browse freely through the various pages of the Site without being bound by an order.

4.2 Placing an order

If the User wishes to place an order, he/she shall select the various Products in which he/she is interested, and shall express said interest by clicking on the “shopping cart” icon.
At any time, the User may :

obtain a summary of the Products he has selected, by clicking on the basket.
continue or modify his selection of Products by clicking on “Back to the catalog”.
finish his selection of Products and order these Products by clicking on “Go to checkout”.
To order the Products he has chosen, after having clicked on “order”, every User will have to fill in the form provided, on which he will indicate his name, first name and postal address.

The User is informed and accepts that entering these two identifiers is proof of his/her identity and manifests his/her consent.
Once the User is identified, he/she must validate the delivery address (as specified in article 5 below) and an order form will appear on the screen, summarizing: the nature, quantity and price of the Products selected by the User, as well as the total amount of the order, the shipping costs, the delivery time, the User’s contact information, and the delivery address of the Products.

4.3 Final validation of the order and payment

After having read the status of the order, and once all the information requested has been completed by the User, a summary of this information and the order will appear and the User must choose the method of payment with which he/she wishes to make his/her payment in order to definitively confirm his/her order.
Orders are payable in : euros by French or international credit card
It is specified that by making an immediate payment by credit card, the User will then be automatically switched to the electronic payment server of the secure payment platform. This platform is secured by S.S.L. (Secure Socket Layer) encryption in order to protect all data related to payment methods, and at no time will the User’s banking data be transmitted on Madame Ferment’s computer system.
As soon as the User validates his/her payment, the order is recorded. The User becomes a Customer. The order form will be recorded on the computer registers of Madame Ferment and will be considered as proof of the contractual relationship between the Parties.
In accordance with Article 6 below, the Customer has a right of withdrawal and refund, during a period of fourteen (14) working days from the date of receipt of the Products by the Customer.

4.4 Confirmation of the order

A summary of the order will be displayed once the order is validated.
This confirmation will include all the elements of the contract between the Parties.
This order summary will also be sent by e-mail to the Customer in the minutes following his purchase.

ARTICLE 5 – DELIVERY

5.1 Delivery times and methods

Your orders are processed as quickly as possible by the Customer Service and Shipping Department, open from Monday to Friday inclusive.
Orders are prepared as soon as payment is received. Payment by credit card guarantees rapid processing of your order.

Delivery time
Shipments are made within 48 hours after receipt of payment for your order, unless otherwise indicated on the “basket” page. The delivery is made in followed letter.
After delivery, your order is delivered within an average of 3 working days for deliveries in Metropolitan France and 10 days for international deliveries.
These times are in working days, excluding postal delivery problems.

5.2 Delay / absence of delivery

Loss of parcel during transport
It is possible, as in any shipment, that there may be a delay in delivery or that the package gets lost. In the case of a delay in delivery of more than 7 days, the Customer must inform Madame Ferment who will transmit the information to the Post Office. This investigation can last up to 21 days from the date of its opening. If during this period, the package is found, it will be forwarded immediately to the customer’s home (in most cases). If, on the other hand, the parcel is not found at the end of the 21-day investigation period, the Post Office considers the parcel as lost. In this case, Madame Ferment will send a replacement package to the Customer, at his expense. If the lost product(s) is (are) no longer available at that time, Madame Ferment will reimburse the Customer for the amount of these products.

Order cancellation
In the event of a delay in delivery of more than 7 days in relation to the scheduled delivery date, the Customer may cancel the order by contacting Madame Ferment’s Customer Service via the contact form available on the website.

ARTICLE 6 – RETURN AND RIGHT OF WITHDRAWAL

Conditions of withdrawal
The Customer has a right of return of fourteen (14) days as from the reception of the totality of his order to retract without necessarily giving reason.

To exercise the right of withdrawal, the customer must notify his decision to withdraw from his order by a written statement unambiguous specifying his name and surname, e-mail, address, order number and date:

Refund

In the event of the Customer’s withdrawal, Madame Ferment will reimburse the payments received from the Customer without undue delay and, in any event, no later than fourteen (14) days from the day Madame Ferment is informed of the Customer’s decision to withdraw.
In the event that the Customer withdraws from the entire order, Mrs Ferment will reimburse all payments received from the Customer for this order.
If the Customer withdraws from a part of the order, Madame Ferment will refund the amount of the returned Products.
The refund will be made by the same means of payment that the Customer used for the order or by bank transfer.
Madame Ferment may postpone the refund until the Products have been received and checked.

Return of products

The Customer must return the Products no later than fourteen (14) days after having communicated his decision to withdraw.
The returned products must be unopened, complete and undamaged.
The return of the parcels must be done at the following address

accompanied by the return form available at the bottom of the page or the following information on plain paper: name and surname, e-mail, address, order number and date.
The Customer shall be responsible for the cost of returning the entire order or the Products.

ARTICLE 7 – QUALITY GUARANTEE

The Customer benefits from a quality guarantee on Madame Ferment’s products.
If the defect is proven, Madame Ferment undertakes to exchange or reimburse the defective or non-compliant products as well as the possible return costs within fourteen (14) days.

ARTICLE 8 – DATA PROCESSING AND LIBERTIES AND PRIVACY

The personal information collected as part of distance selling is essential for processing and delivering orders, as well as for issuing invoices. This information is strictly confidential.

In accordance with the General Data Protection Regulation (GDPR) and the “Data Protection and Freedom of Information” law, we are committed to ensuring the confidentiality and security of our customers’ personal data.

ARTICLE 9 – DISPUTES

This contract is subject to French law. Madame Ferment shall not be held liable for any damages of any kind, whether material or immaterial or physical, which may result from the improper use of the products sold.
In case of difficulties in the application of this contract, the Customer has the possibility, before any legal action, to seek an amicable solution in particular with the assistance of a professional association of the branch, an association of consumers or any other council of its choice.
Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in the person who takes the trouble to explain his situation. In the event of a dispute, the Customer shall first contact the company to obtain an amicable solution.
In the absence of an amicable agreement between the Parties, the dispute shall be submitted to the French courts, unless otherwise provided by law.
